(c) All forms of smoking, including but not limited to cigarettes, cigars, pipes, vaporizers and e-cigarettes, are strictly prohibited on board Carnival ships, except in certain designated outdoor deck areas and designated casino/nightclub rooms. All cabins and suites, including outdoor balconies, are NON-SMOKING. In accordance with Carnival`s smoking policy, any possession or consumption of marijuana on all Carnival vessels is strictly prohibited at all times, regardless of local, state, or other laws that may permit the use or possession of marijuana. Carnival complies with U.S. federal law prohibiting the possession or use of marijuana on its vessels for any reason. Any guest bringing marijuana or illegal controlled substances on board that violates Carnival policies or U.S. or international law, including port or flag state law, will be reported to local and/or federal authorities and in the United States. Customs and Border Protection for possible arrests and/or enforcement actions. Carnival may deny boarding or disembark to any guest who brings or attempts to bring marijuana or illegal substances on board, without refund to the guest and at its own expense for repatriation and travel. Customer agrees to strictly adhere to Carnival`s smoking policy.

Customer further agrees that any violation of Carnival`s smoking policy will also result in damages to Carnival, including, but not limited to, loss of goodwill, revenue, cleaning, maintenance, fines, and/or other costs of the guest. Any signs of smoking in a cabin or balcony, e.g. smoke/residue smell, spillage, ash, upholstery/furniture burns, smoke detector alteration is a violation of Carnival`s smoking policy. Guests who violate our smoking policy will be required to pay a fee of $500 per violation to the customer`s Sail & Sign account and may also result in all guests disembarking in the cabin. Fines are set in the functional currency of the vessel, which may differ from the currency used to guarantee the reservation. These passengers are solely responsible for all resulting penalties and expenses to return home, and no refund will be given for the price of their unused cruise. Customer further acknowledges and agrees that any breach of this Policy constitutes, in Carnival`s sole discretion, a material breach of this Cruise Agreement. In the event of such a breach, the Customer loses all rights under this Agreement, including the right to remain on board.

Carnival reserves the right to disembark guests at any port designated by Carnival. Carnival will not be liable for any refunds or other compensation or damages of any kind to a guest who disembarks or disembarks in accordance with this provision because another guest has disembarked. These guests may also be banned from sailing with Carnival in the future. (g) Carnival may use facial recognition technology to enable boarding and disembarking when the ship enters and disembarks at ports of call in all photos taken by Carnival during the passenger`s journey and photos that the customer uploads to the Carnival mobile application. Carnival removes biometric facial identifiers at the end of travel prior to subsequent travel. All unidentified photos will be deleted within thirty (30) days of the end of each trip or sooner upon request. All photos identified and linked to the customer`s Sail and Sign guest ID will be retained for two (2) years to allow the guest to access and purchase photos and photo memorabilia after the end of the trip. Photos can be deleted earlier if you want. Carnival does not share facial recognition records with third parties outside the Carnival Corporation & plc group of companies. In some cases, our ability to exercise these rights on your behalf may depend on our obligations to process personal data for security, fraud prevention, compliance with regulatory or legal requirements, or because the processing is necessary to provide the services you have requested.
